Terms of Service
Version 2026-10-08 · Draft — to be reviewed by a lawyer before public release.
Plain-English summary: your company owns its data; you're responsible for the estimates you send and for who you let into your account; don't copy or misuse the app; and our liability is limited. The full terms below are what count.
1. The agreement
These Terms of Service ("Terms") are an agreement between you and DCAJ Enterprises LLC, an Idaho limited liability company doing business as Preflight Surface Consultants and Preflight Cleaning Pro ("Preflight", "we", "us") for the Preflight Cleaning Pro app, the office web page, and related services (together, the "Service"). By creating an account, joining a company, or using the Service, you agree to these Terms. If you use the Service for a company, you agree for that company too, and you confirm you have authority to do so. If you don't agree, don't use the Service.
You must be at least 18 years old to use the Service.
2. Accounts, companies and team members
Each company account has an owner. The owner (and any admins they choose) decides who is invited, what role each person has, and when someone is removed. The company is responsible for everything done under its account and by the people it invites.
Keep your sign-in private. Don't share accounts. Tell us right away at the contact below if you think someone has used your account without permission.
When a team member is removed, their access ends. The Service signs them out on their devices and erases the app's offline copy of company data where the device allows. Removing access promptly when someone leaves is the company's responsibility.
3. Plans, fees and trials
Some features may require a paid plan. Prices, what's included, and billing periods are shown when you sign up or upgrade. Fees are charged in advance, are not refundable except where the law requires, and don't include taxes, which you pay. We may change prices with at least 30 days' notice; the change applies at your next billing period. Free trials and early-access programs end when stated, and we may change or end them.
If a payment fails, we may limit the account until it's paid. Your data isn't deleted for non-payment until the account is closed under section 14.
4. Your data
Your company owns its data — customers, contacts, estimates, floor plans, photos, notes and everything else you enter or upload ("Company Data"). You give us permission to host, copy, process, transmit and display Company Data only as needed to run, secure, support and improve the Service for you, and as described in the Privacy Policy.
You're responsible for having the right to collect and use the information you put in the Service, including your customers' personal information, photos and building scans, and for getting any permission the law or your customers require. The Service includes a permission-to-scan feature; using it doesn't by itself guarantee you've met every legal requirement where you work.
Don't store payment card numbers, bank account numbers, government ID numbers, or passwords for other services in the Service. The "payment on file" feature records only where payment details are kept and the last four digits.
When Preflight support helps you, we only see your company's data at the level of access your owner allows in Settings, and those visits are logged.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent, deceptive or harmful;
- copy, sell, resell, rent or sublicense the Service, or use it to build a competing product;
- reverse engineer, decompile or try to extract the source code, pricing logic or data structures of the Service, except where the law expressly allows;
- scrape, bulk-download or export data from the Service by automated means other than features we provide;
- get around or test security features (including sign-in, roles, screenshot protection, logging or rate limits) without our written permission;
- upload malware or content that infringes someone else's rights;
- send spam or unwanted messages through the Service's email features;
- take company or customer information you got through the Service for use outside your work for that company, including after you leave it.
6. Security features and monitoring
To help companies protect their information, the Service may hide sensitive screens from screenshots and screen recordings, record when a screenshot or recording happens, log sign-ins and team changes, and notify the company owner. Company owners can see these records for their company. By using the Service as a team member you agree to these protections.
7. Estimates, measurements and pricing
The Service is a tool. Measurements (including LiDAR scans), seat counts, square footage, suggested prices, service plans, tax calculations, training content and proposal wording are aids and may be wrong. You're responsible for checking every measurement, price and proposal before you send it, and for the work you agree to do. You're also responsible for your own licenses, insurance, sales tax, payment terms, card surcharge and discount rules, and any other laws that apply to your business.
8. Other services
The Service relies on third parties such as Google Firebase (hosting and data), Apple (the iOS app), email delivery providers, map apps and, if you connect them, QuickBooks Online or payment processors. Your use of those services is also governed by their terms. We aren't responsible for third-party services, and connected-service features may change if those services change.
9. Our property
We own the Service, including its software, design, pricing engine, training content we provide, and our trademarks. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your company's internal business while your account is active. If you send us ideas or feedback, we may use them without owing you anything.
10. Confidentiality
Each side will protect the other's non-public information it receives through the Service with reasonable care and use it only for the purposes of these Terms. Company Data is your confidential information. Non-public features, pricing logic and product plans we share with you are ours.
11. Changes and availability
We work to keep the Service available and your data safe, but we don't promise it will be uninterrupted or error-free. We may add, change or remove features. Early-access and beta features may change quickly. We'll give reasonable notice before removing a major feature you rely on for a paid plan.
12. Disclaimer
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows.
13. Limits on liability
To the fullest extent the law allows: (a) neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, jobs or data, even if warned they were possible; and (b) our total liability for all claims about the Service is limited to the amount you paid us for the Service in the 12 months before the event that caused the claim (or $100 if you paid nothing). Some places don't allow these limits, so they may not fully apply to you.
14. Indemnity
You'll defend and hold us harmless from claims by third parties (including your customers and team members) arising from your Company Data, the estimates and work you provide, or your breach of these Terms or the law.
15. Ending the agreement
You can stop using the Service and close your account at any time. We may suspend or end access if you seriously or repeatedly break these Terms, don't pay, or if the law requires it; where reasonable we'll tell you first. After an account is closed, the owner can ask for an export of Company Data for 30 days; after that we may delete it, except copies we must keep by law or that remain in backups for a limited time. Sections that by their nature should continue (such as 4, 5, 9, 10, 12–14, 16 and 17) survive.
16. Changes to these Terms
We may update these Terms. When we make a material change, we'll update the version date above and ask you to review and accept the new Terms in the app or on the office web page before continuing. If you don't accept, stop using the Service and you may close your account.
17. General
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules, and disputes will be handled in the state or federal courts located in Ada County, Idaho, unless the law where you live requires otherwise. If part of these Terms can't be enforced, the rest stays in effect. Not enforcing a term isn't a waiver. You can't transfer these Terms without our consent; we may transfer them with our business. These Terms and the Privacy Policy are the whole agreement about the Service, unless you and we sign a separate written agreement.
